These terms and conditions (the "Terms") apply to your use of the Testimonial Hub website, including any related services or features provided through the website (collectively, the "Service"). The Service is operated by Pragmatech Software Solutions Ltd ("Pragmatech", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms and any additional terms applicable to certain programs in which you may elect to participate, as any of them may be amended from time to time. • Use our Service to create false or misleading information, commission false testimonials, post testimonials without reasonable checks, offering to submit or facilitate writing fake testimonials;

2. Availability and Downtime

We strive to ensure that our Service is available 24/7, however, we do not guarantee that our Service will be uninterrupted or error-free. We are not liable for any loss or damage arising from the Service's unavailability.

3. Intellectual Property Rights

The Service and its original contents, features, and functionality (including but not limited to information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Pragmatech Software Solutions Ltd, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws of the United Kingdom and other applicable jurisdictions.

4. Indemnification

You agree to indemnify and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to our Service; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of our Service caused damage to a third party.

6. Fair Usage Policy

Fair usage is defined by the total utilisation of resources for the capture, retrieval and display of your testimonials and is determined by a reasonable assessment of cost to price ratio. We reserve to right to suspend an account that is over-utilising the service. Suspended accounts will not be charged while offline and our team will liaise with you directly investigate next steps.

7. Premium Tier Widget/API Licensing

For users of our premium tier widget/API, additional licensing terms apply, which are outlined on our Premium Tier Licensing page. These premium tier licensing terms are incorporated by reference into these Terms. In the event of any inconsistency between these Terms and the Premium Tier Licensing terms, the Premium Tier Licensing terms shall prevail with respect to the use of the premium services.

8. Governing Law

These terms are governed by the laws of the United Kingdom, without regard to its conflict of laws principles.

9. Changes to Service

We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.
